Welcome to WatchLog. These Terms ("Terms") form a legal agreement between you and Virstack ("we", "our", or "us") and govern your use of the WatchLog mobile app and related services (together, the "Service"). By installing or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 13 years old to use WatchLog. If you are under the age of legal majority in your jurisdiction, you confirm that a parent or guardian has reviewed and accepted these Terms on your behalf.
2. Your account
- You are responsible for keeping your login credentials secure.
- You agree to provide accurate information when creating an account.
- You are responsible for all activity under your account.
- Notify us promptly at info@virstack.com if you suspect unauthorised access.
3. Acceptable use
You agree not to:
- Use the Service for any illegal or harmful purpose.
- Reverse engineer, decompile, or attempt to extract source code, except where permitted by law.
- Interfere with or disrupt our servers, networks, or other users' access to the Service.
- Attempt to gain unauthorised access to any part of the Service or its related systems.
- Use automated tools (bots, scrapers) to access the Service in a way that imposes an unreasonable load.
- Upload content that infringes intellectual property, contains malware, or violates the rights of others.
- Resell, sublicense, or commercially exploit the Service without our written permission.
4. Free service
WatchLog is provided free of charge. We reserve the right to introduce optional premium features in the future. Any paid features will be clearly disclosed before purchase. The core tracking and discovery functionality will remain free.
The Service is provided "as available" and we may modify, suspend, or discontinue any part of it at any time without prior notice.
5. Your content
Watchlist entries, ratings, reviews, and profile settings you create remain yours. By using the Service you grant us a limited, worldwide, royalty-free licence to store, transmit, and process your content solely to operate the Service for you — for example, syncing your watchlist across devices and generating personalised recommendations based on your viewing history.
6. TMDB content
Movie and TV show metadata, posters, cast information, and episode data displayed in the app are sourced from The Movie Database (TMDB). This content is owned by TMDB and its contributors and is not owned by WatchLog or Virstack. Your use of this content is subject to TMDB's terms of use. This product uses the TMDB API but is not endorsed or certified by TMDB.
7. Intellectual property
The WatchLog app, brand, logos, designs, and underlying software are the intellectual property of Virstack and are protected by copyright, trademark, and other laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for its intended purpose while you comply with these Terms.
8. Third-party services
The Service integrates with third-party providers including TMDB and Sentry. Your use of those providers is also subject to their own terms and privacy policies. We are not responsible for third-party services or content.
9. Disclaimers
The Service is provided "as is" and "as available", without warranty of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any defects will be corrected.
10. Limitation of liability
To the maximum extent permitted by law, in no event shall Virstack, its affiliates, or its personnel be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any direct damages shall not exceed USD 50.
11. Indemnification
You agree to indemnify and hold Virstack harmless from any claims, damages, liabilities, costs, or expenses arising from your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.
12. Termination
- You may stop using the Service and delete your account at any time.
- We may suspend or terminate your access if you breach these Terms or if we discontinue the Service.
- Sections that by their nature should survive termination (e.g., intellectual property, disclaimers, liability limits) will continue to apply.
13. Governing law
These Terms are governed by the laws of the State of Delaware, United States of America, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in the State of Delaware for the resolution of any dispute arising from or relating to these Terms or the Service. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
14. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the Last updated date and, where the changes are material, notify you in-app or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
